SUBMISSIONS & SCHOLARSHIP SPONSOR

Entry shall be submitted via mail to Sponsor at the below referenced address.This Scholarship is sponsored by:
Favor the Brave, 70 State Street, 3rd Floor (entrance at 76 State Street) Newburyport, Massachusetts 01950

All applications will be evaluated based on originality, creativity in answering the brief, and technique. From the pool of postcards, 10 finalists will be notified and asked to submit a 1-minute video of themselves explaining why they should be chosen to win. Any questions regarding this Scholarship should be directed to hello@favorthebrave.co. A minimum of 10 applications are required to run the scholarship.

INTRODUCTION AND SCHOLARSHIP RULES

The following rules shall apply to the Scholarship (“Scholarship”), its associated prizes, promotions, and giveaways that are promoted on and/or through the Favor the Brave, (“Sponsor”) website, social media platforms, and/or other media platforms.

a. To enter the Scholarship the Entrant must enter as directed on the Sponsor’s website, social media platforms, and/or other media platforms and meet the criteria herein set.

b. THERE SHALL BE NO FEE OR PAYMENT OF ANY KIND REQUIRED OR NECESSARY TO ENTER, PARTICIPATE, OR WIN THIS SCHOLARSHIP OR PRIZE(S) ASSOCIATED WITH THIS SCHOLARSHIP.

c. The Scholarship shall be governed by these official rules (“Official Rules”). Entrants (“Entrant”) hereby acknowledges, understands, and agrees that by participating in and/or winning this Scholarship, each Entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Scholarship, as determined by Sponsor and its agents, is final and binding in all respects. Entrant hereby acknowledges, understands, and agrees that by participating in and/or winning the Scholarship or any corresponding prizes, winner hereby agrees to release Sponsor, its parents, affiliates, subsidiaries, agents, and assigns and/or their respective officers, directors, employees, agents, and assigns from any and all liability with respect to the Entrant’s participation in and/or the subsequent winning of the Scholarship or any of its corresponding prizes. The Scholarship is subject to all federal, state and local laws and regulations and is void where prohibited by law.

d. The postcard submission must meet the following criteria:

  1. Entrants must prepare one original 4x6” heavy grade (such as cord stock) postcard. Duplicate submissions will be disqualified. On the front side of the postcard Entrant shall visually answer the following: What evoked your passion to travel? Entrants should keep an open mind, share her motivations to travel or where she would want to go. Entrants should showcase her skills, passions, and individuality to convey a compelling and cohesive visual story. On the backside Entrants shall pro provide her name, address, email, phone number, age and a sentence caption of her creation.

  2. Entrants must follow Favor the Brave & The Newburyport Studio on Instagram.

  3. 3. Ten (10) Entrants shall be chosen as finalists (“Finalists”) by Sponsor, from the postcard submission. The Finalists shall create video submissions in order to be entered to win the Scholarship.

e. The Finalist video submission must meet the following criteria:

  1. Finalists must prepare one original sixty (60) second video submission. Any video submission longer than 60 seconds, will only be evaluated through the first sixty (60) seconds only. Finalist’s video must be in a format compatible with Vimeo, such as .WMV, .AVI, .MOV or .MPG. Only one video scholarship submission per Finalist. Subsequent entries will be disqualified.

  2. Video entries must not be derogatory, offensive, threatening, defamatory, slanderous, libelous, disparaging, nor shall the videos contain any content that is illegal, inappropriate, indecent, sexually explicit, profane, impolite, or discriminatory in any manner. Any submission found to violate any of the foregoing terms will result in the submission / entry being disqualified.

  3. Video submissions must not contain content, material or any element that displays any third-party advertising, slogan, logo, trademark, or otherwise indicates a sponsorship or endorsement by a third party.

  4. Finalist’s video must be an original, unpublished work that does not contain, incorporate, or otherwise use any content, music, material, or element that is owned by a third party or entity. Finalist must only use original music or music in which written consent by the music’s composer/author was provided to use in Finalist’s video submission. Finalist is responsible for submitting a complete list of production credits. Failure to provide proper documentation of consent to use such materials will result in the submission / entry being disqualified.

  5. Prior to filming Finalist agrees to obtain written consent of any and all third-party property owners when filming on property, not owned by Finalist. Failure to provide proper documentation of consent to use third-party property owner’s land will result in the submission / entry being disqualified.

f. Any promotions of the Scholarship on social media are in no way sponsored, endorsed, administered by, and/or associated with Facebook, Instagram, Twitter, Tik Tok, LinkedIn, Google, Yahoo or any other social media network and/or platform. Any questions, comments, or complaints regarding the promotion of the Scholarship shall be directed exclusively to Sponsor.

ELIGIBILITY & RESTRICTIONS

a. Entrant must be a female, between eighteen (18) to twenty-two (22) years of age, at the time of entry. Entrants must be interested in or actively pursuing a higher education in a creative field such as, but not limited to, Graphic Design, Illustration, Photography, Industrial Design, Art, Architecture, Interior Design, Animation, Videography, Fashion Design, or other such similar fields of study. Sponsor reserves the right to determine whether such field of study is suitable for the Scholarship.

b. Each Entrant may only enter the Scholarship one time and must be a real person, not a corporate and/or other type of entity. Entrant must be a United States citizen and must possess a valid and current passport, in Entrant’s name, with at least 8 months left before expiration, verification may be required by Sponsor.

c. Employees, officers or agents of the Sponsor or employees, officers or agents of any person or organization involved in the managing, running, or promoting of the Scholarship, and their respective family members, are prohibited from winning.

d. Entrants must possess access to the internet, have a legitimate email and/or social media account.

e. The Sponsor shall have the sole discretion to determine the maximum number of entries for the Scholarship during the Scholarship Period. There shall be no minimum number of entries. Once the published closing date for entries is met, the Scholarship will be closed to new entries.

f. The Sponsor reserves the right, in its sole discretion, to: (a) disqualify from this or any contest it sponsors, now or in the future, any person it finds, in its sole discretion, has: (i) violated these Terms and Conditions and Official Rules, (ii) entered or attempted to enter the Scholarship more than the permitted number of times through the use of multiple email addresses or any other means, or (iii) tampered with the Entry process, the operation of the Scholarship, or any other aspect of the Scholarship; and (b) modify, cancel or suspend part or all of the Scholarship in the event that human or technical errors occur in the administration of the Scholarship or the processing of Entries, or other errors, printing errors, tampering, fraud, unauthorized intervention, technical failure, acts of God, natural disasters, wide spread illness, public health crisis or pandemic (e.g., COVID-19), terrorism, weather or any other causes beyond the Sponsors control, corrupt or impair the administration, security, fairness or proper play of the Scholarship, or interfere with the Sponsors ability to run the Scholarship as planned (a “Force Majeure Event”). In the event the Scholarship is cancelled, suspended or discontinued for any reason, the Sponsor may take any and all appropriate actions in its sole discretion, including, but not limited to, judging and awarding prizes based on Entries received up to the time of the Scholarship cancellation or suspension. The Sponsor reserves the right, in its sole discretion, to extend the Entry Period in the event that the Sponsor for any reason receives an insufficient number of qualified Entries in the Scholarship (as determined by the Sponsor in its sole and absolute discretion).

WINNER SELECTION

a. All eligible entries received by Sponsor during the Scholarship Period will be gathered and evaluated by Sponsor at the conclusion of each Phase of the Scholarship Period. The finalists will be chosen based on their entry in Phase One and final winner will be chosen based on her final entry on Phase Two. Winner will be notified of the result by Sponsor via email or mail or by direct message on social media not more than 30 days following the Announcement Date. The winner shall collect her Scholarship Prize / Award (“Award”) within the remaining days of the year awarded.

b. All reasonable efforts will be made to contact the Entrant winner for fourteen (14) days, using the contact information provided by Entrant at the time of entry, but if the potential winner cannot be contacted, fails or refuses to claim the Award, or fails or refuses to respond to the winner notification, or provide the required information by the due date, or meet the eligibility requirements or is otherwise unable to comply with the competition terms and conditions, the Award shall be deemed undeliverable and the winner shall be considered by Sponsor to have forfeited the Award. Sponsor reserves the right to award and/or designate the next eligible Entrant as winner.

c. The results of the Scholarship will be announced on Sponsor’s website within 30 days following the conclusion date of the competition. The announcement may include the name and photograph, the town or region of residence and Scholarship details of the winner.

SCHOLARSHIP PRIZE / AWARD

a. The Award winner shall be determined by Sponsor. Certain terms and conditions may apply to the Award. Incidental expenses and all other costs and expenses which are not specifically listed as part of the Award in these Official Rules and which may be associated with the Award, acceptance, receipt and use of all or any portion of the awarded Scholarship, prizes, or awards are solely the responsibility of the respective Scholarship, prize, and/or award winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT AND/OR USE OF ANY SCHOLARSHIP, PRIZE, OR AWARD IS SOLELY THE RESPONSIBILITY OF THE WINNER AND HEREBY AGREES TO HOLD HARMLESS SPONSOR.

b. The Award is non-transferable. No substitution or cash equivalent of prizes is permitted. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Scholarship, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Scholarship is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Scholarship, without notice, and for any reason, including, without limitation, if Sponsor determines that the Scholarship cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Scholarship. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

ADDITIONAL TERMS, CONDITION, LIMITATIONS, AND WARRANTIES BY ENTRANT

a. By entering, Entrant represents and warrants to the Sponsor, that the submitted postcard and video, and all its accompanying documents, is the Entrant’s own original work; that the Entrant is the sole owner of the video and all of the rights associated with it; that the video does not violate any rights of others; and that the video does not display any illegal or inappropriate material. Entrant hereby agrees to release and hold harmless the Sponsor, their respective affiliates, directors, officers, employees, attorneys and representatives from any and all liability for any injuries, loss claim, action, demand, or damage of any kind arising from participation in the Scholarship.

b. By entering the Scholarship, Entrant represent and warrant as follows: (a) Entrant’s entry does not and will not, to the Entrant’s knowledge, violate any applicable laws; and (b) Entrant’s entry complies with all of the requirements and conditions of these Terms and Conditions and Official Rules.

INDEMNIFICATION AND LIMITATION OF LIABILITY

BY ENTERING THE SCHOLARSHIP, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS THE SPONSOR AND ITS PARENT COMPANY OR COMPANIES, SUBSIDIARY COMPANY OR COMPANIES, AFFILIATES, AGENTS AND AGENCIES, THE SOCIAL MEDIA AND/ OR MEDIA PLATFORMS COMPANY OR COMPANIES IN WHICH THE SCHOLARSHIP IS PROMOTED, ADMINISTRATORS, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL OF THE ABOVE ORGANIZATIONS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY AND ALL LIABILITY, DAMAGES, LOSSES OR INJURY, TAX LIABILITY, RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SCHOLARSHIP OR IN ANY SCHOLARSHIP RELATED ACTIVITY AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE / AWARD. SPONSOR AND ITS PARENT COMPANY OR COMPANIES, SUBSIDIARY COMPANY OR COMPANIES, AFFILIATES, AGENTS AND AGENCIES, THE SOCIAL MEDIA PLATFORMS COMPANY OR COMPANIES IN WHICH THE SCHOLARSHIP IS PROMOTED DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE / AWARD. SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY ELECTRONIC DEVICES, COMPUTERS OR COMPUTER SYSTEMS RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE SCHOLARSHIP. Except where prohibited, by participating in the Scholarship, Entrant agrees that: (a) any and all disputes, claims, and/or causes of action arising out of or connected with the Scholarship, or any prize awarded, or the determination of the winner(s), shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Scholarship, but in no event shall attorneys’ fees be awarded; and (c) under no circumstances will the Entrant be permitted to obtain awards for, and the Entrant hereby waives all rights to claims, punitive damages, incidental damages, consequential damages or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. THE PARTIES HERETO HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS AND OFFICIAL RULES OR THE SCHOLARSHIP WHETHER SOUNDING IN CONTRACT OR TORT LAW AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.

PUBLICITY, INTELLECTUAL PROPERTY RIGHTS, AUTHORIZATION AND PRIVACY

a. Publicity As a condition of entry, Entrant agrees to permit the Sponsor to use Entrant’s name and/or likeness and video for advertising and promotional purposes without additional compensation, unless prohibited by law. The Entrant voluntarily consents to and hereby grants permission to the Sponsor to use submitted photograph(s), name, story and/or voice for communication purposes, including without limitation in publications on the web, and hereby releases the Sponsor from any liability that may result from a use consistent with said release. Each Entrant grants Sponsor permission to use Entrant’s name, likeness or comments for publicity purposes without payment of additional consideration, except where prohibited by law.

b. The Entrant grants the Sponsor a perpetual, irrevocable, worldwide, royalty-free and non-exclusive license to use, reproduce, adapt, modify, publish, distribute and publicly display a video (1) for the purposes of allowing the Sponsor and the judges to evaluate the video for purposes of the scholarship, and (2) in connection with advertising and promotion via communication to the public. Once submitted, video and postcard entries become the sole property of the Sponsor and will not be returned.

c. The sponsor will not disclose Entrant’s personal information, such as phone number or e-mail address, to any outside entity. Entrant’s personal information will be used only to determine eligibility and distribute scholarship funds.

d. Entrant authorizes the Sponsor to use their entry, name, voice, likeness, biographical data, city and state of residence and entry materials in promotional material and for advertising, public relations and editorial purposes worldwide, in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation. Entry constitutes Entrant’s consent and permission for Sponsor to use winner’s entry, name, hometown, likeness, photograph, voice and statements regarding this contest in all media now known or hereafter discovered, for any purpose, including without limitation, in connection with, and to promote, market or advertise, the contest, in whole or in part, without review, approval, credit or attribution, notification or payment from or to entrant or any person or entity, worldwide, in perpetuity, or on a winner’s list.
